NECA CEO Testifies on Worker Misclass
This Wednesday, April 19, 2023, NECA CEO David Long testified before the
House Education and Labor Subcommittee on Workforce Protections on worker misclassification and the danger that this practice poses to the construction industry. Read his full written testimony here.
NECA's Take: NECA thanks the subcommittee’s ranking member, Congresswoman Alma Adams (D-NC), for the opportunity to testify before the subcommittee on this important issue. Currently, no legislation has been introduced addressing worker misclassification. We will be monitoring any legislative or administrative action on this issue.
NECA Endorses Procurement Legislation
On April 19, 2023, Rep. Pete Stauber (D-MN), along with Rep. Scott Peters (D-CA), Rep. Marc Veasey (D-TX), and Rep. Brian Fitzpatrick (R-PA) reintroduced the Small Business Payment for Performance
Act. This bill would ensure fair treatment of small construction companies during the procurement process while protecting these businesses from unexpected financial burdens that occur during the project.
NECA's Take:NECA applauds Rep. Stauber along with his other colleagues on introducing this important piece of legislation, and NECA was proud to endorse the bill on April 19th. This legislation will help ensure NECA contractors receive an equitable adjustment for any change order the federal government may request and that they are paid sooner for the work they have completed. We will be monitoring the Small Business Payment for Performance Act closely as it moves through the legislative process.
Senate Holds Confirmation Hearing for DOL Secretary
On April 20, 2023, the Senate Heath, Education, Labor, and Pensions Committee held a confirmation hearing for the next Labor Secretary nominee, Acting Secretary Julie Su. President
Biden nominated Su after former Secretary Marty Walsh left office in March. Before joining the Department of Labor, Su served as the California labor commissioner from 2011 to 2018, then as secretary for the California Labor and Workforce Development
Agency from 2019 until 2021. She has long been a supporter of labor protections.
NECA's Take: NECA urges the Senate to fill the Secretary of Labor position as quickly as possible to ensure the Department of Labor can continue to provide essential support for our industry. We will continue to monitor Acting Secretary Su’s nomination progress.
