Week in Review
White House Releases State-By-State Fact Sheets on Private Investments
President Biden, along with cabinet officials, have begun a 20-state tour of private investments that companies have made that coincide with the investments from
the Inflation Reduction Act, the CHIPS and Science Act, the Infrastructure Investment and Jobs Act, and the American Rescue Plan. The White House has also released state-by-state fact sheets of private investments in semiconductors, biomanufacturing, EVs/Batteries, clean energy, and other projects.
NECA's Take: NECA is closely monitoring the funding opportunities being released by the respective agencies and will alert NECA chapters of the work opportunities as they arise.
WOTUS Rule Takes Effect
The final "Revised Definition of 'Waters of the United States'" rule was published in the Federal Register on January 18, 2023,
and took effect on March 20, 2023. The Rule is operative in all jurisdictions of the United States except Idaho and Texas. The House in March passed a Congressional Review Act that would overturn this regulation and President Biden is expected to
veto it. The Supreme Court heard oral arguments on this regulation and has indicated that it will likely strike down the rule.
NECA's Take: NECA Government Affairs has urged Congress to overturn this burdensome regulation and will continue to monitor this regulation as it progresses to the Supreme Court. We are hopeful that the Supreme Court will strike down this rule to ease the regulatory impact on NECA Contractors across the country.
