Davis-Bacon Rates Never More Important; Do Your Part To Help Your Local Area Prevail!

In general, the Davis-Bacon Act requires that the locally prevailing wage rate be paid to various classes of workers on covered projects. In its May 29, 2009, All-Agency Memorandum, the U.S. Department of Labor Employment Standards Administration's Wage and Hour Division made it clear that all requirements of the Davis-Bacon Act apply on construction projects that are "funded directly by or assisted in whole or in part by and through the Federal Government as a result of the American Recovery and Reinvestment Act of 2009" (ARRA, the stimulus legislation passed in February 2009).
With stimulus monies still flowing out of Washington, it has never been more important to try to get the Davis-Bacon Prevailing Wage Rate as the locally negotiated wage rate. NECA chapter offices and IBEW local unions have specific duties in the process, but there’s also an important role for contractors. That is, every signatory contractor should adopt an internal policy and procedure to document the work contracted on a Form WD-10: Report of Construction Contractor's Wage Rates that may be sent in to the Department of Labor, filled out on-line, or retained for the DOL survey that may occur.

January 13 Registration Deadline For Employee Benefits Conference
The IBEW-NECA Employee Benefits Conference will be held January 28-29 at the Naples Beach Hotel and Golf Club in Naples, Florida, and January 13 is the deadline to reserve your place at the conference and the hotel. Designed for local benefit plan trustees or others involved in labor negotiations, this conference will address today's complex health and pension issues and focus on how to improve or expand our reciprocal agreements with the IBEW.
