Davis-Bacon Rates Never More Important; Do Your Part To Help Your Local Area Prevail!

In general, the Davis-Bacon Act requires that the locally prevailing wage rate be paid to various classes of workers on covered projects. In its May 29, 2009, All-Agency Memorandum, the U.S. Department of Labor Employment Standards Administration's Wage and Hour Division made it clear that all requirements of the Davis-Bacon Act apply on construction projects that are "funded directly by or assisted in whole or in part by and through the Federal Government as a result of the American Recovery and Reinvestment Act of 2009" (ARRA, the stimulus legislation passed in February 2009).

With stimulus monies still flowing out of Washington, it has never been more important to try to get the Davis-Bacon Prevailing Wage Rate as the locally negotiated wage rate. NECA chapter offices and IBEW local unions have specific duties in the process, but there’s also an important role for contractors. That is, every signatory contractor should adopt an internal policy and procedure to document the work contracted on a Form WD-10: Report of Construction Contractor's Wage Rates that may be sent in to the Department of Labor, filled out on-line, or retained for the DOL survey that may occur.

Be sure to discuss this important topic with your chapter office, which may be able to provide additional information. For Davis-Bacon information from the DOL Wage and Hour Division, click here.

VICE Enables Military Veterans To Graduate To Electrical Careers

Eight veterans whose military training helped fast-track them toward electrical careers graduated from the first Veterans in Construction Electrical (VICE) program last month and are already working for local contractors in the Seattle area. This joint venture between NECA’s Puget Sound Chapter and IBEW Local Union 46 centers on a 12-week boot camp where veterans learn key components of the job. Rep. Adam Smith (D, WA-9) has introduced legislation to expand the VICE program nationwide.

Final Vote On Senate Health Care Bill Expected Christmas Eve

On Saturday, Senate Majority Leader Harry Reid (D-NV) released the manager's amendment to the Senate health care reform bill, 383 pages of compromise language crafted to overcome the objections of individual Democratic and Independent senators. (All Republicans are poised to vote against the bill.) Just after 1:00 a.m. yesterday morning, the Senate voted 60-to-39 to cut off a threatened filibuster and move forward. The final vote on the overall bill is tentatively set for 7:00 p.m. Christmas Eve.

EC Publisher Quoted In MSNBC Story On Counterfeit Electrical Products

A new article on the MSNBC website opens with a warning against counterfeit Christmas lights, but John Maisel, publisher of NECA's ELECTRICAL CONTRACTOR magazine, points out that the problem is much more worrisome than that because electrical contractors can be fooled into buying and installing fake products that imperil end-users. EC is a founding partner in the Anti-Counterfeit Products Initiative which offers news and practical advice at www.counterfeitscankill.com.
