EPA in Hot Water over WOTUS

In a surprise decision by the U.S. General Accountability Office (GAO), the government’s watchdog agency found that the Environmental Protection Agency (EPA) violated federal law by using taxpayer dollars for covert propaganda and unauthorized publicity as well as for grassroots lobbying against legislation pending in Congress that would have sent the controversial Waters of the U.S. (WOTUS) rule back to EPA for a rewrite. This decision further gives credence to claims that the agency violated the integrity of the rulemaking process and could have a major impact on future court proceedings. As of now the NECA-opposed WOTUS rule cannot be implemented due to a national stay ordered by U.S. Sixth Circuit Court of Appeals on October 9. NECA continues to monitor the status of this rulemaking and will continue to oppose its final approval and implementation.
